Terms and Conditions
Please review these Terms and Conditions. Your booking confirmation constitutes your complete and binding agreement to the terms below.
1. Definitions
1.1. The Studio: Refers to Someone’s Studio, its premises at Al Khayyat Avenue, its equipment, its staff, and its official representatives. We, us, and our also refer to The Studio.
1.2. The Client: Refers to the person, company, or organization that books The Studio. You and your also refer to The Client.
1.3. The Agreement comprises the booking confirmation document and these Terms and Conditions.
1.4. The Premises: Refers to all areas of The Studio accessible to The Client.
1.5. Equipment: Refers to all property owned or leased by The Studio, including but not limited to cameras, lights, sound gear, and post-production hardware.
1.6. Booking Duration: The specific, continuous period you have reserved The Studio's use.
1.7. Fees: All costs associated with your booking, including studio hire, optional personnel, post-production, and any additional charges.
1.8. Confidential Information: Includes all non-public business, creative, and technical information exchanged between you and us.
2. Bookings, Reservations, and Changes
2.1. All booking requests are subject to availability. A booking is confirmed only upon our written confirmation and receipt of your deposit.
2.2. We may place a temporary hold on a date for you. A hold is a tentative reservation. We reserve the right to release a hold after 24 hours without notice.
2.3. The Booking Duration is fixed. It starts at the agreed time and ends at the agreed time. All your setup and breakdown activities must happen within this duration.
2.4. Any extension to the Booking Duration requires our prior approval and will incur Overtime Fees. We grant extensions based on studio availability.
2.5. Any change request for a confirmed booking's date or time is subject to our approval.
3. Fees, Payments, and Charges
3.1. You agree to pay all Fees as specified in your booking confirmation. All Fees are quoted in AED and are exclusive of any applicable Value Added Tax (VAT).
3.2. A 50% non-refundable deposit from the total Fee is required to confirm any booking. This payment secures your requested date and time.
3.3. The remaining 50% balance payment is due 72 hours before your Booking Duration's start. We require cleared funds before your session begins.
3.4. Overtime Fees apply for any use beyond the agreed Booking Duration. The rate for overtime is 150% the standard hourly rate, billed in 30-minute increments.
3.5. An overdue invoice balance accrues a late payment charge. The charge is five percent of the outstanding amount per month.
3.6. You agree to settle all invoices within 14 days from their issue date.
4. Cancellation and Rescheduling Policy
4.1. A cancellation you make with more than 72 hours' notice before the Booking Duration's start permits the deposit's use as a credit for a future booking.
4.2. A cancellation you make within 72 hours before the booking forfeits the entire deposit. We retain the full deposit amount for such late cancellations.
4.3. A failure to appear for a booking constitutes a cancellation. It forfeits all payments you have made.
4.4. A request to reschedule a booking within 72 hours is treated as a cancellation. The same forfeiture terms apply.
5. Studio Use and Client Responsibilities
5.1. You agree to use The Studio and its Equipment competently and professionally. You will follow all our staff's instructions regarding safe equipment use.
5.2. You are fully responsible for all individuals you invite onto The Premises, including your employees, contractors, talent, and guests.
5.3. The Studio has a maximum capacity limit for safety. You agree to respect this limit. We will inform you of the specific capacity for your booking.
5.4. The Studio maintains a smoke-free and vape-free environment. All clients and guests will respect this policy.
5.5. You agree to keep The Premises free from all hazardous materials, illegal substances, and open flames.
5.6. Food and drink must remain inside the designated lounge and hospitality areas.
5.7. You accept full financial responsibility for any repair or replacement cost for studio property or Equipment. Your acceptance covers damage caused by you, your team, or your guests.
5.8. You agree to leave The Premises in the same clean and orderly condition as they were at your booking's start. A cleaning fee may apply otherwise.
5.9. You accept responsibility for all equipment you bring onto The Premises. You warrant that all your electrical equipment has proper safety certifications.
6. Optional Services: Personnel and Post-Production
6.1. Studio Only (Dry Hire): A dry hire booking gives you access to the agreed studio space and its permanent fixtures. It includes basic power and house lights. All other Equipment and personnel are your responsibility.
6.2. Studio with Technical Team (Wet Hire): A wet hire booking includes the studio space plus the services of our in-house technical crew. The specific crew members' roles and number will appear in your booking confirmation. Our crew operates our Equipment only.
6.3. Post-Production Services: We offer optional post-production work, including video editing, color grading, and sound design. These services are quoted separately from studio hire. Each post-production project is subject to its scope, timeline, and deliverables agreement.
7. Content, Copyright, and Intellectual Property
7.1. The Client retains full intellectual property ownership for all media created during your booking. The recorded material is yours entirely. All ownership rights belong to you.
7.2. You grant us a limited right to use your final, publicly released content in our promotional materials. We will always seek your prior written consent before any such use.
7.3. You warrant you have all necessary permissions, licenses, and releases for all talent, music, and third-party material you record in The Studio. You will provide copies upon our request.
8. Liability, Indemnity, and Insurance
8.1. The Studio's total liability for any loss, claim, or damage arising from this Agreement is limited to the total Fee you have paid for your booking.
8.2. We accept no responsibility for loss or damage to your personal property or equipment you bring onto The Premises. You retain full responsibility for your items.
8.3. You retain complete creative and commercial responsibility for your project. Your project's artistic quality and commercial success remain your responsibility.
8.4. You agree to indemnify and defend The Studio against all claims, liabilities, and costs arising from your use of The Studio or any breach of this Agreement.
8.5. You agree to obtain and maintain Public Liability Insurance with a minimum coverage of 2,000,000 AED for the duration of your booking. We reserve the right to request your insurance certificate.
9. Confidentiality
9.1. Both parties agree to keep all Confidential Information private. We will protect the details of your project. You will protect the details of our business operations. This obligation continues after your booking's completion.
10. General Provisions
10.1. This Agreement is the entire agreement between The Studio and The Client. It supersedes all prior discussions.
10.2. A failure by us to enforce any term of this Agreement does not constitute a waiver of our rights.
10.3. If a court finds any clause of this Agreement invalid, the remaining provisions will continue in full force and effect.
10.4. This Agreement is governed by the laws of Dubai and the United Arab Emirates. All parties agree to the Dubai courts' exclusive jurisdiction.
10.5. In the event of a force majeure, such as a natural disaster or government mandate that prevents a booking, we will work with you in good faith to reschedule your session. A refund is not possible in such circumstances.
